Partner visa
(sc820/sc801 and s309/ sc100)
Allows the partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia.
This Visa allows the spouse or de facto partner of an Australian citizen, permanent resident or eligible New Zealand citizen to live in Australia. This visa can be lodged onshore or offshore and the applicant must be sponsored by their Australian partner. Partner visa is a two stage (temporary and permanent) visa, and an applicant applies for both visa at the same time and paying only one fee. If eligible, then you will be granted with temporary visa (subclass-309 for offshore applicants/820 for onshore applicants) first which allows you to live and work in Australia. If the relationship is still genuine and ongoing at the end of two years that the applicant will be granted a permanent visa.

Permanent visa may be granted despite the partner relationship has ended because the applicant is a victim of family violence provision.
Subclass 820
Partner visa (temporary)
This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia temporarily. Getting this visa is the first step towards a permanent Partner visa (subclass 801).
Stay
Temporarily until your permanent Partner visa (subclass 801) application is finalised or you withdraw your application.

Processing times
With this visa, you can
live, work and study in Australia while we process your permanent Partner visa
travel to and from Australia as many times as you want
attend free English language classes provided by the Adult Migrant English Program if you are eligible
apply for access to Australia’s public health care scheme, Medicare.
You must
be in a genuine relationship with your spouse or de facto partner who is an Australian citizen, permanent resident or eligible New Zealand citizen
have your spouse or de facto partner sponsor you
be in Australia when you apply for this visa and when we decide your temporary visa application. Family who apply with you must also be in Australia.
Subclass 801
Partner visa (permanent)
This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia permanently. It is usually only for people who currently hold a temporary Partner visa (subclass 820).

sponsor eligible family members to come to Australia

hold a temporary Partner visa (subclass 820) or Dependent Child visa (subclass 445)
in most cases, continue to be in a genuine and ongoing relationship with your sponsor.
Subclass 309
Partner visa (Provisional)
This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia temporarily. Getting this visa is the first step towards a permanent Partner visa (subclass 100).
Stay
Temporarily until your permanent Partner visa (subclass 100) application is finalised or you withdraw your application.

With this visa, you can
live, work and study in Australia while we process your permanent Partner visa
travel to and from Australia as many times as you want

The visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen, live in Australia permanently. It is usually granted to people who hold a temporary Partner visa (subclass 309).
